Click behaviour and visitor data
We monitor general visitor data on the website. As part of this process, information such as your computer’s IP address, the time of the visit to our website and the data sent by a visitor’s browser in particular may be registered.
How we use your data
We use your data for various purposes:
- If you leave us your data by filling in the contact form, your personal data are used to fulfil your request/enquiry.
- If you fill in the ‘Service Evaluation’ form in connection with a matter in which you asked us to represent your interests, your data will be used to share the outcome of the evaluation with the lawyer acting on your behalf.
- Your personal data are then stored in your file. It is possible to submit suggestions regarding the services provided anonymously. In that case no data are retained.
- If you fill in the ‘Submit a claim’ form in your capacity as creditor, we process your data in connection with our legal obligation (as court-appointed receiver or administrator) to represent the interests of all creditors.
- Finally, we process in a general sense data that are generated whenever you visit our website. These data are used for statistical analysis of visitor behaviour and navigation on the website
Transfer of personal data
We do not transfer your personal data to other parties. It is possible that your personal data are stored by one of our service providers (e.g. the party hosting our website). In that case we remain (primarily) responsible for the personal data, although we have entered into data processing agreements with the aforementioned service provider(s) pursuant to which they assume responsibility for the processing concerned.
Personal data are not transferred to countries outside the European Economic Area (EEA). EEA countries are all the EU Member States plus Liechtenstein, Norway and Iceland.
How long we retain your data
The length of time we retain your data depends on the reason for which we process your data (see also ‘How we use your data’).
- If you have left us your data by filling in the contact form then we process your data to respond to your enquiry. If your enquiry does not result in the creation of a file, we retain your data for a maximum of one year. If your enquiry does result in the creation of a file, we will inform you further regarding the retention periods which then apply. In the unlikely event that this information is not provided, for whatever reason, you may assume that the data are retained for up to a maximum of 20 years after the file is closed, with a minimum period of one year. The retention period of 20 years results from the generally applicable limitation period laid down in the Dutch Civil Code.
- The data you enter when filling in the ‘Service Evaluation’ form are stored with your file. These data are subject to retention periods which we will explain to you further when handling your file.
- Data which you have submitted through the ‘Submit a claim’ form are processed in the bankruptcy file concerned. We retain your data in any event for as long as the insolvency proceedings are ongoing. Once the insolvency proceedings have been brought to a final conclusion, we retain your data for a maximum of 20 years, with a minimum retention period of one year.
- We retain general data about your visit to our website for no more than one year, unless the data concerned do not allow identification of you personally.
Your rights
As a data subject you have the following rights:
- You have the right to request access to your personal data.
- You have the right to request the rectification of inaccurate personal data.
- You have the right to request that your personal data be erased.
- You have the right to request and receive your personal data so that you can transmit your personal data to another service provider (the right to data portability).
- If your personal data are processed on the basis of your consent, you have the right at all times to withdraw this consent. If your personal data are processed on another basis, in the context of providing you with legal advice, for example, then your personal data will continue to be processed on this other ground.
- You have the right to lodge a complaint with the Autoriteit Persoonsgegevens (the Dutch Data Protection Authority) (www.autoriteitpersoonsgegevens.nl) if you believe that we are interfering with the processing of your personal data.
What is a cookie?
HerikLegal uses cookies on this website. A cookie is a simple text file that is sent with this website’s pages [and/or Flash applications] to your computer and is stored on your computer’s hard disk by your browser. The information stored in the cookie can be sent back to our servers the next time you visit our website.
